In NSW, if a driver is caught committing a major traffic offence, NSW police can suspend that driver’s licence on the spot. Further to the above, it should be noted that the police can also give a person an immediate licence suspension notice at any time within 48 hours after a person has been charged or after they have received a fine.

It should be noted that the person’s Driver’s licence will be suspended immediately upon receiving the notice on the spot.

It should also be noted that for more serious offences, police can also impound the driver’s vehicle or even confiscate the number plates of that motor vehicle.

Police have the power to suspend a person’s drivers’ licence on the spot if any of the following occurs:

Committing a serious Driving Offence causing GBH (Grievous Bodily Harm) or Death.

Refusing or failing to submit to a breath test or a blood sample.
