Getting caught driving an unregistered vehicle in Sydney is one of the most common – and most expensive – traffic mistakes people make. The fine is steep, demerit points are automatic, and the consequences can snowball very quickly if your registration has lapsed for a long time or if you are caught multiple times.
At Nicopoulos Sabbagh Lawyers Criminal Defence & Traffic Lawyers we handle hundreds of unregistered / uninsured vehicle matters every year in Sydney courts. We know exactly when police and Revenue NSW get the facts wrong, how to fight the charge on technical grounds, and how to turn a potential conviction + licence suspension into a Section 10 non-conviction result or a much shorter disqualification.
Here’s the complete 2026 picture: current fines, demerit points, licence risks, defences, court outcomes and what you should do the moment you receive the penalty notice.

Current fines & demerit points (1 January 2026)
The Road Transport Act 2013 (NSW) and Road Transport (General) Regulation 2021 set the penalties. As of 1 January 2026 the indexed amounts are:
- Driving an unregistered vehicle (first offence)
Fine: $758
Demerit points: 3
- Driving an unregistered vehicle (second or subsequent offence within 5 years)
Fine: $1,896
Demerit points: 3
- Driving an uninsured vehicle (compulsory third-party insurance)
Fine: $758 (first) / $1,896 (repeat)
Demerit points: 3
Strong Defences & Section 10 Outcomes
You can fight the charge in court and often succeed. The most successful defences we run include:
- Genuine emergency / necessity
- Registration actually current (RMS / Service NSW error)
- Honest & reasonable mistake of fact
- Section 10 non-conviction order
Extremely strong prospects when:- first offence
- short lapse period
- no crash / injury
- compelling hardship (licence loss = job loss, sole carer, medical appointments)
- completed Traffic Offender Intervention Program (TOIP)
- good character references
Never Represent Yourself on an Unregistered Charge
These matters look simple on paper but are deceptively difficult. One line in the police facts (“defendant admitted knowing the vehicle was unregistered”) or a weak hardship letter can destroy a Section 10 application or good-behaviour licence request.
