One common
question we usually receive when giving legal advice to clients in relation to
a Traffic related offence is ‘’can I be fined if I don’t stop at a yellow
traffic light?’’
The short
answer is yes, you can be fined, and, in this article, we will break down the
law to you and explain why you can be fined.
Road
Rules 2014- Rule 57
Rule 57 of
the Road Rules 2014 notes that you must stop at traffic lights, stop lines and
intersections if it is safe to do so. Rule 57 of the Road Rules 2014 notes that
all drivers (including riders) must slow down when a traffic light turns yellow
and stop at the marked line or close to the line of the road, UNLESS it
is not safe to do so.
An example
of a situation where it may be ‘unsafe’ to do so is if driver 1
slams his brakes and Driver 2 who happens to be travelling behind the driver 1
does not have enough time to react, this can result in an accident.
What is
the penalty for not stopping at a Yellow Traffic Light?
Failure to
stop at a Yellow Traffic Light will result in a $469 fine and 3 demerit points
and $587 and 4 demerit points if this offence occurs during the school zone
hours.
