Being charged with driving unlicensed in New South Wales is far more serious than many people realise. Whether you have never held a licence, your licence has expired, been suspended, cancelled, or disqualified, driving without proper authority is a criminal offence that can result in immediate licence suspension, heavy fines, demerit points, and — in repeat cases — actual imprisonment.
In Sydney, unlicensed driving charges are among the most common traffic matters handled in Local Courts. Police detect them during routine stops, RBT operations, accidents, or when running a routine licence check. The consequences extend well beyond a simple fine: a conviction creates a criminal record that appears on police checks for ten years, affects employment in licence-required jobs, increases insurance premiums, and can lead to further disqualification periods.
At Nicopoulos Sabbagh Lawyers Criminal Defence & Traffic Lawyers, our traffic and criminal lawyers in Sydney defend unlicensed driving charges every week in the Downing Centre, Parramatta, Blacktown, Burwood, Liverpool, Campbelltown, Sutherland and Penrith Local Courts. We regularly obtain Section 10 non-conviction orders, have charges withdrawn on technical grounds, and achieve non-custodial outcomes even in repeat matters through strong mitigation and hardship appeals.
This detailed 2026 guide explains the offence of driving unlicensed in NSW, the current penalties, the different ways the charge can be laid, common defences, realistic sentencing outcomes we see in Sydney courts, and practical steps to take if you are charged.

The Offence of Driving Unlicensed – Section 53 Road Transport Act 2013
The main offence is contained in s 53 of the Road Transport Act 2013 (NSW). It is committed when a person drives a motor vehicle on a road or road-related area without being the holder of a driver licence that authorises them to drive that class of vehicle.
There are several common variations:
- Never held a licence
- Licence expired
- Licence suspended (demerit points, unpaid fines, medical reasons)
- Licence cancelled or disqualified by court order
- Holding a licence but driving a class of vehicle not authorised (e.g. driving a heavy vehicle on a car licence)
The charge is summary and is almost always dealt with in the Local Court.
Current Penalties for Driving Unlicensed (2026 Indexed)
First offence
- Maximum fine: $2,200 (20 penalty units)
- Maximum imprisonment: 6 months (rare on first offence)
- Automatic disqualification: 3 months (court can increase)
- Demerit points: 3–5 depending on circumstances
Second or subsequent offence
- Maximum fine: $3,300
- Maximum imprisonment: 12 months
- Automatic disqualification: 12 months minimum (often longer)
Aggravating circumstances (e.g. driving while disqualified after previous serious traffic offences, causing an accident, or while suspended for high-range PCA) significantly increase the likelihood of a custodial sentence and longer disqualification.
Additional consequences:
- Conviction recorded on your criminal record for 10 years.
- Insurance premiums rise substantially.
- Further demerit points added, potentially triggering another suspension.
- For professional drivers (Uber, taxi, truck), loss of accreditation.
Defences & Mitigation That Frequently Raised
- Necessity
Driving was reasonably necessary to avoid greater harm (e.g. rushing a seriously ill child to hospital when no other transport was available). Strong evidence is required (medical records, witness statements). - Unlawful stop or arrest
If the initial police interaction was unlawful, any evidence obtained may be excluded under s 138 Evidence Act 1995. - Section 10 non-conviction order
No conviction recorded. Very achievable in first-offence cases with good subjective circumstances (employment hardship, family responsibilities, completion of Traffic Offender Intervention Program, strong character references).
Practical Steps If Charged with Driving Unlicensed
- Do not drive until the matter is resolved — further unlicensed driving worsens the situation.
- Elect court on any penalty notice — paying the fine accepts the conviction.
- Gather strong subjective material — employer letters (job loss risk), family affidavits (carer responsibilities), medical evidence.
- Complete the Traffic Offender Intervention Program early — shows remorse.
- Seek urgent legal advice — early preparation significantly improves chances of a Section 10 or reduced penalty.
