Dangerous Driving is one of the most serious offences under the Road Transport Act in NSW and the penalties which the offender may receive will be subject to a variety of facts and circumstances, for example was anyone harmed? Was the driver intoxicated? Was the Driver Driving in a dangerous manner for an extended period? And many other considerations. A person who is found guilty of such an offence can face mandatory licence disqualification by the court as well as fines or even a term of imprisonment!

 

 

Dangerous Driving Occasioning Grievous Bodily Harm

A person who is found guilty by the Court can be sentenced up to 7 years imprisonment if the matter is dealt with in the District Court! This offence occurs in circumstances where a person’s dangerous driving results in another person sustaining a serious injury to their body. Did you know that if the offence was aggravated, a person can face up to 11 years imprisonment?!

 

 

Drive in a manner Dangerous.

This offence is usually dealt with in the Local Court and the maximum penalty is a term of imprisonment of 9 months and or a fine of 20 penalty units for a first offence.

 

 

Dangerous Driving Occasioning Death

If dealt with on indictment in the District Court, this offence has a maximum penalty of up to 10 years imprisonment. This offence occurs in circumstances where a person’s dangerous driving results in another person’s death. Did you know that if the offence was aggravated, a person can face up to 14 years imprisonment?!
